You are provided with access to this Website in accordance with these Conditions and any orders placed by you must be placed strictly in accordance with these Conditions.

We reserve the right to:

• modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or
• change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. Prices

All prices on our web site are in pounds sterling (£). If your order is being delivered to a UK or European addresses you will be charged the main price. We accept MasterCard, Mastercard Debit, Visa, Visa V pay, Visa Debit (Delta), Visa Electron, Maestro and PayPal. Cheques are also accepted (cheques are only accepted for mail order, cheques will not be accepted at shows) and should be made payable to "Mr TWR Caton or Colchester Militaria". Orders paid for by cheque will be delayed for 28 days to allow the cheque to be cleared, all other payment methods will be not be delayed.

We try to make sure that the prices on our website are accurate but it is possible that an error may occur. If we discover an error in pricing of the goods in your order we will inform you as soon as possible using the contact details you supply us and give you the option of reconfirming your order at the correct price or cancelling it. (If we are unable to reach you we will treat the order as cancelled). In the event of an order being cancelled, any payment already made for the goods will be refunded in full.

All offers are available while stocks last. If we are unable to supply a particular item, which you have ordered, or if the correct price for an item is different from the price on your order, we will notify you as soon as we can after receiving your order. If this happens, you may cancel your order and we will refund you any money that you have paid.

Delivery

With our standard service we aim to deliver goods to destinations in the UK within 2-7 working days (working days are Monday to Friday). This excludes British bank holidays in most circumstances. If you require your item to be sent next day delivery please contact us before placing an order to check if this is possible.

Orders are sent by Hermes, Royal Mail, Parcel Force or UPS courier service. UPS and Parcel Force will require a signature on delivery, if the delivery address is to a military barracks and providing you have provided a telephone number we will put your telephone number on the outside of the order, so if it gets delivered to the guardhouse somebody at the guardhouse can contact you to say it has arrived.

Orders that relate to deactivated, replica firearms, hand held weapons namely, swords, bayonets etc can only to be sent to addresses which are verified through your banking payment details, this is to protect our consumer and the business Colchester Militaria Ltd.

We will make every effort to deliver within the time stated on our website but we will not be liable for any loss caused to you by late delivery "or" loss of your item by the postal service. If the goods are not delivered within the delivery time that we quote for that item, please contact us within 20 days of the estimated delivery date. We will try and ensure that you receive your order as quickly as possible. If it isn't possible to complete your order we will dispatch what we have in stock immediately and unless specified, follow up with the rest of your order within 21 days.

Due to the nature of the items we send out somtimes we may change the courier service despite you electing a specific delivery courier, there may be mulitpul reasons to this, however an example may be that some couriers wont transport the product "OR" we are diverting the route the item takes in order to secure our courier friends. The delivery specification will never change for example if you pay for next day the same service will be transposed to the other courier.

Unless you have chosen "Before 10 am delivery" your order will be delivered between 9am and 6pm.

Next day delivery options will be delivered the next working day, which is Monday to Friday so if you order on Friday morning it will be delivered on the Monday (unless it is a Bank holiday) only next day Saturday orders will be delivered on a Saturday.

After you have placed your order you will receive an email from us which is your confirmation of order. This is confirmation that we have received your order. It is not confirmation that the order you have placed is guaranteed to be in stock or that it can be fulfilled. Sometimes errors do occur in our stock inventory or other customers order just before you. We cannot be liable or responsible for any loss occurring because your items are not in stock. We will endeavour to contact you as soon as possible if this is the case.

This does not affect your statutory rights as a consumer.

If your delivery Country applies and import or duty taxes it is your responsibility to pay these, we can not advise on likely charges and we do not cover these in the delivery cost.

Additionally it is your responsibility as the consumer to make sure your country receiving any item can legally receive those purchased goods. We hold no responsibility for any loss of such goods should you have not made these enquiries with your country's import rules.

Non Delivery

It is the buyer's responsibility to notify us if the goods have not been received within 20 days of the estimated delivery date or receipt of our invoice.

If no notification is made within this time period the buyer shall be deemed to have received the goods and no refund will be made.

Export restrictions

The following items cannot be exported outside of the U.K. This is either because of shipping restrictions I.E. Pressurised canisters or by law.

• Cans of paint.
• Gun magazines and inert bullets.
• Replica hand grenades.
• Oils or Lubricants

Description of products

We will take all reasonable care to ensure that all the details, descriptions and prices of products on the website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the Website as up to date as possible, the information including product descriptions appearing on this website at a particular time may not always reflect the position exactly at the moment you place an order.

Faulty goods

Our products are packaged to ensure they arrive to you in good condition, however very occasionally items may arrive damaged or with defects. If this does occur then please contact us first by email sales@colchestermilitaria.co.uk or by telephone 07497776029 before sending the items back. In order to qualify for a refund or exchange for a faulty good, you must return the item(s) to us within 24 days from the date of purchase. Once we have received and inspected the returned item, we will replace the item free of charge. Should a refund be requested, then the refund will be made as soon as the item has been returned. Please note should an item arrive faulty or you damage an item by trying to repair / alter or replace an aspect of the item, yourself or getting someone else to do it, Colchester Militaria Ltd reserve the right to waiver a refund, however the consumer (you) may request for the item back. This does not affect your Statutory Rights. Please also note that items made or personalised specifically for a customer may need to refer to our "if you need to return an item" part of the terms of conditions.

If you need to return an item

If you need to return an item to us, please contact us by e mail sales@colchestermilitaria.co.uk first.. We do not pay the postage for items being returned. When you contact us we will advise you how to send the item back to us and what courier service to best use for certain items. We usually ask that you send items back to us via Royal Mail First Class (Recorded).

If for some reason you are not happy with your product you can return it to us for a refund or exchange. Where the customer chooses to exchange an item the sale is final, we will not exchange or refund for the secondary item.

In order to qualify for a refund or exchange, you must return the item(s) to us within 24 days of receiving your item, having taken good care of it and kept it in an unused state, complete with packaging and all its components.

The refund will be made direct to the credit/charge card originally used to place the order. The refund will be made within 7 working days from the item having been returned to us.

Personalised items like printed dog tags and name badges cannot be cancelled or returned, unless there is a spelling mistake on our part.

Items made for a customer specifically cannot be cancelled/refunded, however can be returned for the purpose of being repaired in cases where the item has arrived damaged.

You will not be refunded for the P&P of your item, but please be aware that you are responsible for the returned item until it has reached us. We recommend using a secure delivery method which requires a signature upon receipt such as Royal Mail Recorded Delivery.

This does not affect your statutory rights.

Returns Address

You will be responsible for the item(s) until they reach us and are signed for by our staff. For your own protection, we suggest you use a secure delivery method that requires a signature upon delivery such as Royal Mail First Class (Recorded Delivery). Contact us for returns address.

Our Responsibility

We will not be responsible for any losses resulting from your use or the inability to use our website or resulting from unauthorised access to, or alteration of your transmissions or data in circumstances which are beyond our control.

We will not be responsible for your loss of profits, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong.

You will be responsible if you use this website in breach of these terms of use and will reimburse us for any loss that you cause to us as a result of your misuse.

We make no promise that our website will be uninterrupted or entirely error free. Because of the nature of the Internet, the shopping online service is provided on an "as is" and "as available" basis. We are not responsible to you if we are unable to provide our Internet services for any reason beyond our control.

This does not affect your statutory rights as a consumer.

Cancellations and alterations

Once you have placed your order, you can cancel the order until the moment it has been picked by our team. This includes orders which are personalized or built from scratch, items up to the point they have been made or ordered after which they cannot be cancelled or refunded.

Refunds

When a refund is to be issued this can take up to 7 working days to complete and will be issued back to the original payment method, if your item has been shipped by us we will not refund the shipping fee.

Copying and printing portions of this website is permitted only for the sole purpose of placing an order with us. The materials on our website may not be used for any other purpose without written permission from Colchester Militaria.

Disclaimer

It is the responsibility of each individual for the safe and proper handling of any item purchased from Colchester Militaria accepts no responsibility for the injury or fatality of an individual or third party whilst using any products sold through ourselves. Please note that weapon accessories including deactivated, replica and film props are sold as militaria curios and are not intended for intended use.

Please be aware that we can only sell deactivated weapons, inert ordnance and edged weapons to people who are over 18 years of age. Replicas and Blank Firers are sold according to the VCR Act - to Crown Servants, Theatre or Film Groups / Suppliers, or under the VCR Act. By agreeing to our terms and conditions, you are stating that it is legal for you to purchase under the terms of the VCR Act. By agreeing to our terms and conditions when ordering, you are stating that it is legal for you to purchase replicas or blank firers under the terms of the VCR Act. This also applies to any UK law pertaining to deactivated weapons or inert ordnance. For edged weapons, we require that you email us a copy of your passport or driving licence. Also, any comments or statements you may enter into the customer comments box are taken as a signed statement of fact.
